These Terms of Service (the "Terms") govern your use of the Trolly mobile application and related services (collectively, the "Service"), owned and operated by Money Lat SpA ("Money Lat", "we", "us", or "our"). "You" means the person accessing or using the Service.
Trolly lets you send pre-recorded, scripted humorous telephone calls, selected from a catalog, to a recipient of your choosing. The call is placed shortly after you request it. The audio is fixed and scripted in advance: it is not an interactive conversation, and no one speaks live to the recipient. The Service may only be used to call people you personally know and who have consented to receive the call.
You only choose the call audio and the recipient's number. The Caller ID shown on the call is selected automatically by our backend from numbers that Money Lat owns and controls — you cannot enter, choose, or spoof a Caller ID. Placing a call consumes coins (see Section 6).
You must be at least 13 years old to use the Service. If you are under the age of majority in your place of residence (typically 18), you may only use the Service under the supervision of, and with the consent of, a parent or legal guardian who agrees to be bound by these Terms on your behalf and who is responsible for your use of the Service, including any purchases. We ask that children under 13 do not use the Service. We may terminate or refuse access if we discover you do not meet these requirements or that information you provided is inaccurate.
You are solely responsible for the calls you initiate and for ensuring they comply with all laws that apply to you and to the recipient. You agree that you will not use the Service to:
You agree to use the Service in compliance with all applicable telemarketing and calling laws, including the U.S. Telephone Consumer Protection Act (TCPA) and equivalent laws in your country. You must obtain any prior express consent required from the recipient before sending a call, and you will not use the Service to make unsolicited or spam calls in violation of any law.
By sending a call, you represent and warrant that you comply with all applicable recording laws and have obtained any consent required from the recipient. You agree that recorded data may be stored by us and may be produced to law enforcement or a court if lawfully required. You may delete recordings at any time.
If the Service lets you share a recording, you represent and warrant that doing so will not violate any civil or criminal law and that you have all necessary rights and consents. You must not share recordings that contain sensitive personal information. Money Lat takes no responsibility for recordings you choose to share and may remove any shared content at its discretion.
To access the App and send a call, you must sign in with your Apple or Google account. Sign-in is required before you can use the main features. You are responsible for activity under your account and for keeping access to your sign-in credentials and device secure.
Calls are paid for with coins, a virtual in-app currency. One (1) coin entitles you to one (1) call. Coins are consumable one-time purchases — there is no subscription and nothing auto-renews. If a call is not answered or reaches voicemail, we make reasonable efforts to return the coin to your balance. Coins have no cash value, are not transferable, and cannot be exchanged for money except where required by law. Prices are shown in the App and may change.
Coin purchases are made through in-app purchase and are processed by the Apple App Store or Google Play, and the billing terms of that platform apply. Your App Store or Google Play account is charged for each purchase. We use a third-party purchase analytics provider (RevenueCat) to record and monitor purchases; it does not receive your payment card details.
Except where required by law, all coin purchases are final and non-refundable, including coins already spent. Refund requests for purchases made through a store must follow that store's policies (Apple or Google process and decide such requests, not Money Lat).
Coins are digital content supplied immediately. If you are a consumer in the European Union, the United Kingdom, or another jurisdiction granting a statutory withdrawal ("cooling-off") period, you acknowledge and expressly request that supply of the digital content begins immediately upon purchase, and you accept that you thereby lose your right of withdrawal once a coin has been used. Any unused coins remain subject to the applicable store's refund policy and to your mandatory statutory rights.
Money Lat retains all rights, title, and interest in the Service, including the App, call audio catalog, trademarks, and software. You receive a limited, personal, non-commercial, revocable license to use the Service. You may not copy, modify, resell, reverse engineer, decompile, or attempt to extract the source code of the App, or remove any proprietary notices.
The Service relies on third parties to function (for example, telephone/VoIP carriers, voice APIs, payment processors, and app-store platforms). Your use of the Service is subject to those third parties' terms. Money Lat makes no warranties regarding, and is not liable for, the acts or omissions of any third-party provider.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. Money Lat does not warrant that the Service will be uninterrupted, error-free, secure, or that calls will always be delivered. Availability may be affected by your device, carrier, network, signal, geography, or maintenance.
You agree to indemnify, defend, and hold harmless Money Lat and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, including any call you initiate or content you generate; (b) your violation of these Terms or any applicable law (including the TCPA, telemarketing rules, or call-recording laws); or (c) your violation of the rights of any other person. This obligation survives termination of these Terms.
To the maximum extent permitted by law, Money Lat and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Service. To the extent permitted by law, our total liability for all claims will not exceed the greater of the amount you paid us in the six (6) months preceding the claim, or one hundred U.S. dollars (USD $100). Your sole and exclusive remedy for dissatisfaction with the Service is to stop using it.
You may terminate these Terms at any time by deleting your account and uninstalling the App. We may suspend or terminate your access, with or without notice, if you violate these Terms, misuse the Service, or engage in unlawful conduct. Provisions that by their nature should survive termination will survive.
We may modify these Terms at any time by posting the updated version and revising the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
These Terms are governed by the laws of the Republic of Chile, where Money Lat SpA is established, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights you have in your country of residence. You agree to first attempt to resolve any dispute with us informally by contacting lukas@moneylat.com before initiating any formal proceeding, and to allow at least thirty (30) days for us to respond. Nothing in these Terms limits mandatory legal rights that cannot be waived under the law of your residence, nor deprives a consumer of the protection of the mandatory rules of the country in which they reside.
Where permitted by applicable law, any dispute not resolved informally shall be submitted to the competent courts of Santiago, Chile. This clause does not override any right you may have to bring proceedings in the courts of your own country of residence where such right is guaranteed by mandatory local law.
The App is made available through the Apple App Store and Google Play. The following terms apply to your download and use of the App from those platforms. Where these Terms conflict with the applicable platform's rules, the platform's rules control for the purpose of your use of that platform.
If you download the App from the Apple App Store, you acknowledge and agree that:
If you download the App from Google Play, your use is also subject to the Google Play Terms of Service. You acknowledge that Google is not a party to these Terms and is not responsible for the App. Google Play billing governs your purchases, and refunds are handled under Google's policies.
You agree to comply with all applicable third-party terms of agreement (for example, your wireless data services agreement) when using the App, and with the usage rules of the platform from which you obtained the App.
These Terms, together with the Privacy Policy, form the entire agreement between you and Money Lat regarding the Service. If any provision is held unenforceable, the remainder continues in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
